I think the only issue is payment. You cannot use an E-AB aircraft for commercial purposes, such as commercial flight instruction. I suggest you ask Buzzy Devoll (who offers transition training in a 750 ELSA). My best recollection is that non commercial instruction was acceptable. Buzzy will know.

this is my reply from EAA when i asked that question.


Experimental Amateur-Built aircraft can be used for flight training in only a few scenarios:

1) For transition training, but only after obtaining a Letter Of Deviation Authority (LODA) from the local Flight Standards District Office (FSDO). The LODA allows the owner to charge for the use of the E A-B aircraft.

2) Giving instruction to the owner of the aircraft – No LODA required, and the owner can pay the instructor for his/her time. This can be for any type of training, primary to advanced, flight reviews and endorsements. The owner can also lend the aircraft to another person so that they may obtain training, but cannot under any circumstances receive compensation for use of the aircraft itself, without a LODA.
